Labor Advisory No. 18 Series of 2021
The Department of Labor and Employment (DOLE) has recently issued Labor Advisory No. 18, s. 2021 reiterating the guidelines on the payment of 13th month pay by employers in the private sector to its rank-and-file employees pursuant to Art. 5 of the Labor Code of the Philippines and P.D. No. 851.
- The minimum 13th month pay shall not be less than one-twelfth (1/12) of the basic salary earned by an employee within a calendar year;
- 13th month pay shall be paid by employers on or before December 24 of the same calendar year;
- No request or application for exemption or deferment from payment of the 13th month pay shall be accepted or allowed;
- Employers shall make a report online of their compliance via DOLE’s Establishment Report System (reports.dole.gov.ph) not later than January 15 of the following year.
